The buyer is legally entitled to a right of withdrawal in accordance with § 312g BGB if he is a consumer, since the purchase of goods on the Internet as in this case is a distance contract. Regarding the right of withdrawal and its consequences, a separate cancellation policy in text form is available at the conclusion of the order (see c).
If you are a consumer residing in the European Economic Area (EEA), you are entitled to withdraw from this contract as described in the EU model withdrawal form below according to the consumer rights applicable in the EEA as of 28 May 2022.
a.) Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g. letter or e-mail) of your decision to withdraw from this contract. This is possible by e-mail to [email protected], by phone at +49 5631 505884 or by mail to Martin Kares, Stadtweg 24, 34497 Korbach, Germany. You may use the attached sample withdrawal form for this purpose, but it is not mandatory.
To comply with the withdrawal period, it is sufficient if you send the notification before the period has expired.
Special provision for the Book Membership:
The Book Membership consists of a printed book and supplementary digital content. The statutory right of withdrawal for the digital content expires once the voucher code has been activated and access to the digital content has been granted, provided that the customer has expressly consented to the commencement of performance before the withdrawal period expires and acknowledged the resulting loss of the right of withdrawal. The statutory right of withdrawal for the printed book remains unaffected and is governed by the provisions applicable to physical goods.
b.) Consequences of the revocation
If you withdraw from this contract, we must return to you all payments that we have received from you. This must be done immediately and at the latest within 14 days from the day on which we received the notification of your revocation of this contract.
The refund will be made by the same means of payment that you used for the original transaction, unless you have expressly agreed to another method. In no event will you be charged any fees for such a refund.
For digital content and digital memberships, the right of withdrawal expires prematurely if the customer has expressly consented to the commencement of performance before the withdrawal period expires and has acknowledged that the right of withdrawal is lost once access to the digital content is granted.
